OHS – Occupational Health Service
Occupational health service (OHS) is a legally mandated obligation that applies to every employer. According to Act No. 355/2007 Coll. on the protection, promotion and development of public health, the employer must have OHS services in place even if employing just one employee – regardless of whether it is a permanent employment relationship or an agreement, even for irregular or occasional activities.
Basic requirements in the field of OHS
As an employer, to fulfill legal requirements within OHS, you must ensure:
- Decision of the Regional Public Health Authority on commissioning premises (for some operations, only notification obligation is sufficient)
- Assessment of health risk associated with work and work environment, keeping records of employees classified in categories 2 and above
- First aid training, which must be completed with a valid certificate
- Preventive medical examinations in relation to work – performed at intervals of 1 to 3 years depending on the risk category
- First aid kit with contents and location in accordance with legal regulations
- Operating procedures – valid for selected operations
- Personal protective equipment for health protection and prevention of occupational diseases
- Optimal microclimatic conditions (e.g. temperature and humidity in office or commercial spaces)
Risks associated with non-compliance with OHS obligations
The most common risks include the development of occupational diseases, primarily from category 2 (e.g. musculoskeletal disorders, carpal tunnel syndrome). Consequences can lead to incapacity for work, but also to the employer's obligation to compensate for damage (pain compensation, treatment costs, disability pension). The amount of compensation often runs into tens of thousands of euros.
Violations of Act No. 355/2007 Coll. may result in sanctions ranging from €150 to €20,000.
